Terms and Conditions

– Lochinvar Safaris (LS) defined as a Tour Operator company is duly registered in the Republic of Zambia, Southern Africa under business registration no. 320230073377. The registered office of LS is at Plot 12 Monze, Southern Province of Zambia.

– LS has all rights and the necessary license to offer the Tourism Operator’s services according to the laws of the Republic of Zambia.

– LS is the legal owner and provider of all packaged safaris, tours and activities listed on the TourRadar marketplace platform under Lochinvar Safaris.

– When you book any of the LS tours, activities and experiences, you are considered to have entered into a contract with Lochinvar Safaris. This contract will remain valid and enforceable right until the expiration, termination or end of the tour. You therefore agree to comply with and be bound by these terms and conditions at all times when it is valid.

– The term ‘you’ in this document refers to you as the User of the Lochinvar Safaris Platform browsing through the various tours with the intention to book/or have already booked any one of the tours.

– The content on the various pages on all the tours on the marketplace is for your general information and use only. It is subject to change at any time without notice.

– LS does not guarantee the accuracy, timeliness, performance, completeness or suitability of the information and materials found on all the tours displayed on the marketplace.

– Your use of any information or materials on the tour pages is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any tour products, services or information you use meet your specific requirements.   

– Your use of the information contained in all the tours and any dispute arising out of such use is subject to the laws of the Republic of Zambia.

– In this document, the words Agreement and Contract are used interchangeably and mean the same thing.

 

Market segmentation

Lochinvar Safaris provide mainly tours, activities and experiences at the budget level to its clients. However, on special request and circumstances is able to offer midrange tour operations services.

 

Payments 

– All Prices displayed on every tour on the TourRadar marketplace LS pages is deemed accurate, true and valid for online bookings only, inclusive of certain local prescribed taxes.

– All bookings are for pre-arrival bookings and are finally confirmed only when full payment by credit card is received.

– As and when necessary, we reserve the right to amend the advertised prices on the marketplace at any time. We also reserve the right to correct errors in both advertised and confirmed prices. 

 

Cancellation Policy

  • (a) Cancellation received 60 days or more before departure, participants will receive full refund.
  • (b) Cancellation received 30-59 days before departure, 50% will be refunded to the participant.
  • (c) Cancellation less than 30 days before departure, no refund will be payable.

 

Accommodation facilities

– Accommodation facilities that will be offered to you whilst on tour does not belong to Lochinvar Safaris but sourced from the open hospitality market. The accommodation facilities range from ungraded campsites, guest houses, lodges, camp vans, hotels. In terms of rating, they range from ungraded to about 2 to 3-star ratings. In some instances, you should expect simple accommodation with limited facilities especially in remote places.

– Whilst lodging at any of these accommodation facilities, we accept no liability for any loss or injury sustained. Any claims of recourse should be directed to the owners/manager of the respective accommodation facility.

 

Activities from third party service providers

For any extra or special tours or activities that you will do with any third party activities’ providers, your contract for the services consumed will always be with that particular service provide, not Lochinvar Safaris. LS accepts no liability for any short comings that may happen. 

– You are obliged and encouraged in the strongest terms to ask for the terms and conditions of undertaking any activities with the third [arty service provider.

 

Cutting your Tour short

If you cut short your tour and return home early, we will not offer you any refund for that part of your tour not completed, or be liable for any associated costs you may incur.

 

Request to change Your Booking

If we are able to meet your request to change your booking, you will be required to pay an administration fee of USD120 per person per change. You will as well meet any additional costs and charges incurred by us in making this change.

 

Transfer of Booking

If you or any member of your party is prevented from travelling, that person(s) may transfer their place to someone else, subject to the following conditions:

  • a. that person is introduced by you and satisfies all the conditions applicable to the tour;
  • b. we are notified not less than 7 days before departure;
  • c. you pay any outstanding balance payment, an amendment fee of USD120 per person transferring,

 

If We Change or Cancel your Tour

We reserve the right to make changes or cancel your booking. However, we will make reasonable efforts to inform you as soon as reasonably possible if there is time before your departure but we willhave no liability to you. 

Where we are still able to offer the core tour, no compensation will be payable. Any customers wishing to change or cancel, may do so only in accordance with these Booking Conditions.

 

Cancellation: We will not cancel your tour less than 30 days before your departure date, except for reasons of Events Beyond Our Control or failure by you to pay the final balance. We may cancel your tour before this date if, e.g., the minimum number of clients required for a particular travel arrangement is not reached.

 

Compensation

In addition to a full refund of all monies paid by you, we will pay you compensation as detailed below, in the following circumstances:

  • (a) If, where we make a significant change, you do not accept the changed arrangements and cancel your booking;
  • (b) If we cancel your booking and no alternative arrangements are available and/or we do not offer one.

The compensation that we offer does not exclude you from claiming more if you are entitled to do so.

 

Our Responsibilities 

(1) We will accept responsibility for the arrangements we agree to provide or arrange for you with regards to provision of tours, activities and experiences.

(2) We will not be responsible or pay you compensation for any personal injury or death unless you are able to prove that it was caused by our negligence.

(3) We will not be responsible or pay you compensation for any injury, illness, death, loss, damage, expense, cost or other claim of any description if it results from:

  • (a) the acts and/or omissions of the person affected; or
  • (b) the acts and/or omissions of a third party unconnected with the provision of the services contracted for and which were unavoidable and extraordinary; or
  • (c) Events Beyond Our Control.

(4) We limit the amount of compensation we may have to pay you if we are found liable under this clause:

  • (a) loss of and/or damage to any luggage or personal possessions and money: the maximum amount we will have to pay you in respect of these claims is an amount equivalent to the excess on your insurance policy which applies to this type of loss per person in total because you are required to have adequate insurance in place to cover any losses of this kind.
  • (b) Claims not falling under
  • (c) above and which don’t involve injury, illness or death: the maximum amount we will have to pay you in respect of these claims is up to three times the price paid by or on behalf of the person(s) affected in total. This maximum amount will only be payable where everything has gone wrong and you or your party has not received any benefit at all from your booking.

 

Behaviour

All our customers whilst on tour are expected to conduct themselves in an orderly and acceptable manner and not to disrupt the enjoyment of others. For any perceived bad behaviour, we reserve the right to terminate your participation immediately and withdraw you from the tour without any refund or recourse.

 

Accuracy

If you believe that any details on your booking confirmation or any other document are wrong you must advise us immediately. Changes cannot be made later and it may harm your rights if we are not notified of any inaccuracies in any document within ten days of booking.

 

Enforcement

– This Agreement becomes effective upon making your first deposit payment to confirm the booking. The Contract shall remain valid until the end of the tour unless terminated by either Party in any way such as cancellation of the tour.

– If any provision of this Agreement is held to be illegal or invalid by a court of competent jurisdiction, such provision shall be modified to the extent necessary to make it valid and enforceable; and neither such provision, nor its modification or deletion, shall affect the validity of the remaining provisions.

 

Travel arrangements to and from Zambia.

We may provide general travel information to and from Zambia and whilst in Zambia. However, it is your responsibility to check and fulfil the entry, passport, visa, health and immigration requirements applicable to your itinerary.

 

Insurance

It is a prerequisite condition that you have adequate travel insurance cover before embarking on any of our tours.

 

Governing Laws

This Contract is bound and governed by the laws of the Republic of Zambia.

 

FORCE MAJEURE

We will not be liable for any issues if our contractual obligations to you are affected by Events Beyond Our Control. These are such as natural disasters like floods, the outbreak of serious disease, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination.
